Order Acceptance/Confirmation

Upon placing an order, you will receive an electronic order confirmation. Kyoodoz^® reserves the right at any time after receipt of your order to accept or decline your order for any reason. In the case where we reject your order, you will normally not be charged, but we will process a refund if the charge has been made against you in error.

Paying for Your Order

You may pay for your order by MasterCard, Visa, or Discover credit card only. The accepted methods of payment may change at Kyoodoz’s sole discretion.

Your credit card will only be charged for your order, upon the shipment of our goods to the carrier and you will be charged only for the goods we have actually shipped along with any appropriate taxes or shipping and delivery charges. However, we may pre-authorize your order amount with your credit card issuer at the time you place the order, upon an order modification by you or Kyoodoz^®, and immediately prior to shipment, which may have an effect on your available credit line. Please contact your credit card issuer for more information.

Order Cancellation

You may cancel an order prior to processing and/or shipping. You will be charged a 10% cancellation fee. To authorize a cancellation of your order, you must send an email to us at sales@kyoodoz.com. We may be unable to cancel or modify any purchase from the Website after Kyoodoz^® has processed your order. Any shipped items that you return are subject to a 20% restocking fee and any shipping costs that we incur, these costs include both the original cost we incurred to ship the product to you and any subsequent costs to ship the product back to us. Kyoodoz^® values efficiency and we take pride in our ability to quickly process and ship our orders, so please notify us as soon as possible regarding any cancellations or changes to avoid any unnecessary charges. Errors on the Website

Whilst we try to ensure that the information on the Website is accurate, complete and current, there will still be instances when information about an item contains inaccurate or incomplete data, including data about the item's price or availability. We make no warranty or guarantee that the information on this Website is error-free, complete, or current.

We are required by law to collect state sales tax for Oregon, plus any applicable county, local or district taxes.

Product Usage Liability

As we have no control over the use of the products in this website, we assume no liability connected with their use. Under no circumstances are we, liable for any loss, damage or expenses of any kind arising out of the use or inability to use our products.

Shipping

We do not ship to APO or PO Box addresses. We do not ship on Saturdays, Sundays or major holidays.

All orders placed on this Website are subject to product availability and will be shipped using USPS Priority Mail, unless otherwise instructed. For more information on USPS Priority Mail please visit USPS website. The risk of loss and title for ordered merchandise is passed to you upon our delivery to the carrier. This means that product damaged or lost in transit is the carrier’s responsibility and is an issue to be resolved between you and the carrier.

Should a carrier not meet its delivery performance requirements, this is an issue to be resolved between you and the carrier.

After placing your order, you will receive a confirmation e-mail with details of the order you just placed. Please read through the details of your order carefully and immediately e-mail us if there is any mistake.

Please DOUBLE check your shipping address to ensure that it is the right one.

Kyoodoz^® will not be held responsible for your shipping charges if your address was mistyped.

Your Billing Address MUST match the address where your credit card statements are sent. If your shipping address is different from your billing, your order will not be processed.

All order will be shipped using USPS (United States Postal Service) unless you instruct us otherwise. Please note that we cannot guarantee the exact shipping timeframes for the products to arrive at your address. Should a carrier not meet its delivery performance requirements, this is an issue to be resolved between you and the carrier.

Damage in Shipment

Despite our best efforts, items may occasionally be damaged in transit. Freight carriers are liable for damages only when damage is indicated on the bill of lading before you sign for the shipment. We strongly recommend that you inspect the outside and inside conditions of all products received before signing for the shipment. If any damage is found, write details on the bill of lading and save the shipment, including the outside container and inside packing material. Immediately request that the delivery carrier make an inspection on the shipment. Per ICC (International Chamber of Commerce) regulations, it is the responsibility of the consignee to file a damage claim with the carrier promptly after inspection.

Please note: Kyoodoz^® will accept return of products only if the product is new, unopened and in original packaging, i.e. with the outer plastic tamper-proof bag unopened and undamaged. For more information, please see our Return Policy.

Shipment Refusal

You will be charged a 20% restocking fee of the invoice price and all shipping and delivery charges, should you refuse to accept the shipment of product from shipping company for whatever reasons beyond the control of Kyoodoz^®. Subsequent purchases will require written purchase order. Please refer to our Return Policy.

Shortages

Prior to sending any of our products to our customer, we carefully and thoroughly inspect and count each shipment to ensure that the number of products delivered matches the order. If you purchase more than one product, please inspect that all products are received before accepting the shipment, and get your delivery personnel to verify your claims on the spot. Shortages must be claimed within twenty-four (24) hours from the time that you receive the product.

Return Policy

You will need a Return Merchandise Authorization (RMA) number should you wish to return a product. To request a RMA number you will need to complete the RMA form. The RMA request must be made within 20 days of the purchase date and the RMA number issued is only valid for 10 days from the day of issue. Please e-mail to sales@kyoodoz.com to request for a RMA form. Please note that any products returned without a RMA number will not be accepted.

We accept returns within 20 days from the date of purchase, however, we do not accept exchanges. All items must be new, unopened, undamaged, and still in original, packaging i.e. with the outer plastic tamper-proof bag unopened and undamaged. Kyoodoz^® reserves the right to reject any returns that are deemed tempered with subject to our discretion. Product that shows any sign that it has been used, will not be accepted. Refunds are subject to a 20% restocking fee plus any shipping and delivery costs that we have incurred. This restocking fee covers the credit card processing fee and the restocking of product. There are no exceptions to any part of this policy.

For all returns/refunds, shipping amount is not refundable. You are responsible for making all shipping arrangements for items that you choose to return. We recommend that any returns you send to us be fully-insured and via a carrier that provides tracking information. In the event that a returned package is lost or damaged during shipment back to us, Kyoodoz^® will not make a refund to you. You will need to contact the shipper that you selected and file an insurance claim with them for a refund. All refunds will be made to the person / credit card that made the original purchase. A package that is refused for delivery is the same as making a return and the customer is responsible for all shipping and delivery charges already incurred by Kyoodoz^®. Please remember the estimated processing and shipping timeframes are not guaranteed. Returns must include a copy of your order confirmation e-mail or order/invoice number and should be sent to: customerservice@kyoodoz.com Refunds will be issued after verification of item/items received, checked and approved less any applicable fees.

Kyoodoz^® reserves the right to reject a return item if any of the above conditions are not met.

Privacy Policy

We know that as consumers, you are concern about how the information that you provide online will be used. You can be assured that Kyoodoz^® is committed to protecting your right to privacy. We collect information about our customers to enable us to process orders, improve our site, and provide better services. For your protection, we do not sell your information to other marketers.

For us to process and ship your order, we need your name, phone number, billing address, shipping address, and email address. Your information will be stored on a secure server to allow us to process your subsequent orders more quickly. On occasion, we may notify our customers about Kyoodoz^® specials.

Force Majeure

Kyoodoz^® shall not be responsible for delays or failures in performance, and shall have no liability to purchaser resulting from causes beyond its reasonable control. These includes but not limited to acts of God, natural disasters, war, riot, fire, accident, explosion, terror acts, strikes, or other labor trouble, government acts or omissions, delay or default by subcontractors or suppliers of materials or services, transportation difficulty or shortages in labor, fuel, materials, suppliers, or power at current prices.

We are not liable under any legal theory for consequential or incidental damages arising from shipping delays, system/website downtime, damage or any loss, or expense arising from product malfunction or defect.

Enforcement of Provisions

These Terms are governed and interpreted pursuant to the laws of the State of Oregon, United States of America, without reference to its provisions concerning conflicts of law. Any and all dispute(s) concerning the validity or interpretation of these Terms, or performance hereunder, shall be brought exclusively in a court of competent jurisdiction located in the Washington County, State of Oregon, which shall constitute the exclusive venue for any such

dispute(s). If any part of these Terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions. Kyoodoz^® may revise these Terms at any time by updating this posting. Kyoodoz^® may terminate these Terms at any time, without notice and for any reason. You agree that if any part of these Terms are found to be unenforceable, the remainder of these Terms will remain in full force and effect.
